Terms of Service
Terms for using The Maternity App
Effective 2026-05-25 · Last updated 2026-05-25
These terms govern your use of the The Maternity App platform, the mobile app, the trackers, Sophie (our AI mom-coach), and the OB-shareable report. They form a contract between you and Everseed Ventures (The Maternity App).
By creating an account, logging tracker data, chatting with Sophie, or generating a report you agree to these terms, our Privacy Policy, our Medical Disclaimer, and our Acceptable Use Policy.
01. Who these terms are for
You are a member if you have created a The Maternity App account to track your pregnancy and your baby, talk to Sophie, or generate a report you can share with your OB or pediatrician.
These terms apply equally if you sign up on behalf of yourself and invite a co-caregiver (partner, grandparent, nanny) into a shared baby’s data. Co-caregivers must accept these terms as part of accepting your invitation.
02. What we provide
The Maternity App is a maternal-health tracking and AI coach platform. The core surfaces are:
- Trackers. Ten focused trackers for diapers, feeds, kicks, sleep, growth, vaccines, symptoms, medications, allergies, and solids.
- Sophie. An AI mom-coach who reads what you log, answers questions in plain language, and can write entries back to your trackers on your behalf when you ask.
- OB-shareable report. A PDF you can generate from your logged data and hand to your OB, midwife, or pediatrician.
- Reading material. Stage-aware blogs, guides, and the Sophie’s Minis podcast.
We add, change, and retire features over time. We’ll let you know about anything material before it takes effect.
03. Eligibility and your account
You must be at least 18 to create an account. You’re responsible for the accuracy of the info you provide and for keeping your credentials confidential. If you let someone else use your account, you remain responsible for what they do under it.
One person, one account. If you suspect unauthorized access, tell us at team@maternity.app so we can help you secure it.
04. Not a substitute for medical care
Read this carefully.
Always consult a qualified healthcare professional for medical decisions. If you believe you or your baby is having a medical emergency, call your local emergency number immediately.
See the full Medical Disclaimer for details.
05. Using Sophie, our AI mom-coach
Sophie is an AI assistant that uses large language models to help you understand your tracker data and to log entries on your behalf. Sophie is not a clinician and her replies are not medical advice.
By using Sophie you understand and agree that:
- Sophie can be wrong. Treat her output as a starting point, not a final answer, especially for anything that affects your or your baby’s health.
- Sophie can read every tracker entry tied to your account. That context is what lets her be useful. If you don’t want Sophie to see a specific entry, log it outside the app.
- Sophie can create, edit, or delete tracker entries when you tell her to. You’re responsible for reviewing the draft she proposes before you confirm it.
- We may share anonymized snippets of Sophie conversations with our model providers to improve quality. See our Privacy Policy for how that works and how to opt out.
06. Your tracker data and the OB report
Everything you log in the trackers belongs to you. We store it so you can see it on every device you sign in on, so Sophie can reason over it, and so you can generate the OB report.
The OB report is a PDF you generate yourself from your logged data. When you share that PDF (by email, AirDrop, messaging, or handing your phone over), you control where it goes and who receives it. We don’t deliver it to your provider for you, and we don’t retain a copy of the recipient’s contact details.
You can export or delete your tracker data at any time from Settings → Privacy in the app.
07. Payments and subscriptions
Most of the trackers are free. Some features (full Sophie access, advanced reports, multi-caregiver sharing) require a paid subscription. The current price, what each plan includes, and the length of any free trial are always shown in the app at the moment you subscribe, before you confirm. Prices can vary by region and platform, and from time to time we run promotions, free trials, or introductory offers — the exact terms are displayed at purchase.
Subscriptions are sold and billed by the Apple App Store and Google Play, and managed for us by RevenueCat, our subscription provider. We never see or store your card details. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription anytime from your Apple App Store or Google Play account settings; cancellation takes effect at the end of the period you’ve already paid for.
Refunds are handled by the app store you purchased through, under its own refund policy. If something went wrong, email us at team@maternity.app and a real person will help you sort it out.
08. Acceptable use
You agree to use The Maternity App lawfully and in line with the Acceptable Use Policy. Specifically, you may not:
- Use Sophie to generate content that would harm a real person, including yourself or your baby.
- Attempt to extract our model weights, prompts, or training data, or to reverse-engineer the platform.
- Use someone else’s identity, or log data on behalf of a baby without consent from the legal caregivers.
- Use automated tools to scrape, mirror, or load-test the platform.
09. Safety and emergencies
The Maternity App is not a 911-replacement. If you or your baby is in immediate danger, call your local emergency number. We may, where lawful, contact emergency services or relevant authorities when we have a good-faith belief that doing so is needed to prevent serious harm.
10. Our content and your licence to it
Trackers, illustrations, copy, Sophie’s persona, blog and podcast material, and software are owned by Everseed Ventures (or licensed to us). You get a personal, revocable, non-transferable licence to use them in the app for your own family.
You retain ownership of the data you put into the trackers and your Sophie messages. You grant us a licence to host, process, and display that data so we can run the service for you and (only with your opt-in) improve our models.
11. Suspension and termination
You can close your account at any time from Settings → Account. We may suspend or terminate accounts for material breaches of these terms, fraud, or to comply with the law. When we do, we’ll explain why and (where possible) give you a window to export your data.
12. Disclaimers
The service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and accuracy of Sophie’s output.
13. Limitation of liability
To the maximum extent permitted by law, our total liability under these terms is capped at the greater of the fees you paid us in the twelve months before the claim and CAD $100. We are not liable for indirect, incidental, or consequential damages.
14. Your indemnification of us
You agree to indemnify and hold harmless Everseed Ventures, its officers, employees, and partners from any claim or demand arising out of your misuse of the platform, your violation of these terms, or your violation of someone else’s rights.
15. Governing law and disputes
These terms are governed by the laws of Canada and the applicable laws of the Province of Alberta. Any dispute that can’t be resolved by good-faith discussion will be brought before the competent courts of Alberta, Canada.
16. Changes to these terms
We may update these terms from time to time. When we make material changes, we’ll let you know in the app and by email at least 14 days before they take effect. Continued use of the service after the effective date means you accept the updated terms.
